The most prestigious law school in Australia has two courses which call for elements of sharia law to be recognised in the mainstream legal system — including allowances for polygamy and lowering the age of consent.
One of the Sydney University courses, Muslim Minorities And The Law, is taught by Salim Farrar and Dr Ghena Krayem and it uses a book the pair wrote as “the monograph upon which the unit of study bases its teaching”.
The Daily Telegraph can reveal the book claims “sharia and common law are not inherently incompatible” and that police’s failures to accommodate Islamic religious identity during operations was hampering the fight against Islamist terrorism.
Federal Education Minister Simon Birmingham has warned universities that religion has no place in the law.
“Equality of the law, under the law and before the law should be one of the first principles in our law schools,” he told The Daily Telegraph.
“We all operate under the one legal framework in Australia, applied consistently to all and that is not a matter for negotiation.”
Mr Birmingham’s office also warned universities about using taxpayer funds to promote ideologies at odds with the Australian public
“Universities must keep in touch with Australian community expectations and that includes respect for and adherence to Australian law,” a spokesman said.
“Universities operate under a social license and we rightly expect that the taxpayer funding going to those institutions is being used to deliver benefits to all Australians.”
The book also takes aims at judges for denouncing “conservative Muslim values” during sentencing.
“Where found guilty of transgressing Western values, for example in gender equality, or violating national security, courts have clearly communicated their denunciation of ‘traditional’ or conservative Muslim values when sentencing, dispensing exemplary sentences and announcing aggravating factors, even when the written law does not explicitly demand it,” it says.
The idea of mixing sharia law with Australian law has been criticised by the legal fraternity and Islamic leaders, who said the “division between religion and courts” must be upheld.
However, the authors say when it comes to the law “we will suggest that ‘accommodation’ is not enough and that, as liberal democratic societies, we should move towards a notion of ‘recognition’.”
The authors also call for research into whether polygamy should be legally recognised.
“There is no doubt that this is an area that needs to be researched, particularly given the fact that anecdotal evidence suggests that this is an increasing practice in Muslim communities,” it says.
The course brief for Mr Farrar’s undergraduate course Introduction To Islamic law says it will focus on “shari’ah (the classical laws as derived from the religious sources), and will seek to explain its relationship to the contemporary laws of Muslim states and to the cultural practices of Muslim communities living in Australia and other predominantly non-Muslim states.”
Sharia law is Islam’s religious law. It is often described as a code for living for Muslims. There is ongoing dispute between traditionalists and reformists over its application in Western society.
At its most extreme, sharia law calls for death by stoning for adulterers.
However, the Sydney academics condemn such practices in their writings.
The book says “in terms of police operational practice, there has been little evidence of accommodation of Islamic religious identity across our jurisdictions.
“Rather, evidence suggests police have targeted and discriminated against Muslims simply on grounds of religious identity. While Muslims tend not to object to greater personal intrusions where clearly justified for security reasons, such procedural unfairness is likely to be counter-productive in the fight against Islamist terrorism.”
In a chapter on Islamic Family Law, the authors say a man has the “exclusive” right to divorce his wife and states that sharia does not recognise minimum age in marriage.
“There is no minimum age for a contract of marriage, but it should not be consummated if that would cause harm to the putative spouse.”
It also criticised the Australian legal system for not recognising the religious significance of paying a woman a fee to marry her, a practice known as mahr.
Law Society of NSW president Pauline Wright said universities were “places of ideas and should be exploring them but having said that in terms of the law — in my view — all Australians should be subject to the same law.
“I don’t think bringing different laws in based on the religion of people coming before the courts is appropriate.”

Pedro Alonzo Lopez, whereabouts - unknown, was responsible for the murders of over 350 children, yet in 1998 he was set free despite his vows to kill again.
CHILDHOOD YEARS Lopez was born in 1949 in Tolima, Colombia, a time when the country was in political turmoil and crime was rampant. He was the seventh of 13 children born to a Colombian prostitute. When Lopez was eight, his mother caught him touching his sister's breast, and she kicked him out of the house forever.
TRUST ME, TRUST ME NOT Lopez became a beggar on the violent Colombian streets. He was soon approached by a man who sympathized with the boy's situation and offered him a safe home and food to eat. Lopez, desperate and hungry, did not hesitate and went with the man. Instead of going to a comfortable home, he was taken to an abandoned building and repeatedly sodomized and returned to the street. During the attack, Lopez angrily vowed he would do the same to as many little girls that he could, a promise he later kept.
After being raped by the pedophile, Lopez became paranoid of strangers, hiding during the day and scavenging for food at night. Within a year he left Tolima and wandered to the town of Bogota. An American couple reached out to him after feeling pity for the thin boy begging for food. They brought him to their home and enrolled him in a school for orphans, but when he was 12, a male teacher molested him.
Shortly afterward Lopez stole money and fled back into the streets.
PRISON LIFE Lopez, lacking in education and skill, survived on the streets by begging and committing petty thievery. His stealing advanced to car theft, and he was paid well when he sold the stolen cars to chop shops. He was arrested at the age of 18 for car theft and sent to prison.
After a few days of being there, he was gang-raped by four prisoners. The anger and rage he experienced as a child rose inside him again, consuming him. He made another vow to himself; to never be violated again.
Lopez got his revenge for the rape by killing three of the four men responsible. Authorities added two years to his sentence, deeming his actions as self-defense. During his incarceration, he had time to revisit his life, and a quiet rage toward his mother became monstrous. He also dealt with his sexual needs by browsing pornographic magazines. Between his prostitute mother and the pornography, Lopez's only knowledge of women fed his demented hatred for them.
A MONSTER IS FREED In 1978 Lopez was released from prison, moved to Peru, and began kidnapping and killing young Peruvian girls. He was caught by a group of Indians and tortured, buried up to his neck in the sand but later freed and deported to Ecuador. Experiencing near death did not influence his murderous ways and his killing of young girls continued. The increase of missing girls was noticed by authorities, but it was concluded that they had likely been kidnapped by child peddlers and sold as sex slaves.
In April 1980, a flood exposed the bodies of four murdered children, and the Ecuadorian authorities realized there was a serial murderer at large.
Shortly after the flood, Lopez was caught trying to abduct a young girl after the child’s mother intervened. The police could not get Lopez to cooperate, so they enlisted the help of a local priest, dressed him as a prisoner, and placed him in a cell with Lopez. The trick worked. Lopez was quick to share his brutal crimes with his new cellmate.
When confronted by the police about the crimes he shared with his cellmate, Lopez broke down and confessed. His memory of his crimes was very clear which was remarkable since he confessed to killing at least 110 children in Ecuador, over 100 more in Colombia, and another 100 in Peru. Lopez admitted that he would walk the streets looking for innocent ‘good’ girls who he would lure away with the promise of gifts.
"THEY NEVER SCREAM. THEY EXPECT NOTHING. THEY ARE INNOCENT." PEDRO LOPEZ Lopez often brought the girls to prepared graves, sometimes filled with the dead bodies of other girls he had killed.
He would calm the child with soft reassuring words throughout the night. At sunrise he would rape and strangle them, satisfying his sick sexual needs as he watched their eyes fade as they died. He never killed at night because he could not see his victim's eyes and felt, without that element, the murder was a waste.
In Lopez's confession, he told of having tea parties and playing morbid games with the dead children. He would prop them up in their graves and talk to them, convincing himself that his 'little friends' liked the company. But when the dead children failed to answer, he would become bored and go off to find another victim.
The police found his ghastly confession hard to believe, so Lopez agreed to take them to the graves of the children. Over 53 bodies were found which was enough for the investigators to take him for his word. The public renamed him 'Monster of the Andes' as more information about his crimes became known.
For his crimes of raping, killing, and mutilating over 100 children, Lopez received life in prison.
Lopez never showed remorse for his crimes. In a prison interview with journalist Ron Laytner, he said if he ever got out of prison he would happily return to killing young children. The pleasure he received from his demented acts of murder overpowered any sense of right from wrong, and he admittedly looked forward to the opportunity to wrap his hands around the throat of his next child.
ONE CHILD'S LIFE EQUALS ONE MONTH IN PRISON No one was concerned that Lopez would have the opportunity to kill again. If paroled from the prison in Ecuador, he would still have to stand trial for his murders in Colombia and Peru. But after 20 years of solitary confinement, in the summer of 1998, it is said that Lopez was taken in the middle of the night to the Colombia border and released. Neither Colombia or Peru had the money to bring the madman to justice.
THE MONSTER OF THE ANDES IS FREE What ever happened to The Monster of the Andes is unknown. Many suspect and hope that one of the many bounties offered for his death eventually paid off and that he is dead.
If Lopez has escaped his enemies and is still alive, there is little doubt that he has returned to his old ways.

Gary Gibson, 65, of Oregon, has set up a non-profit organisation - the Association for Sexual Abuse Prevention - to help people like him who choose not to offend.
The Christian ex-teacher, whose family has a history of incestual child abuse, is one of 1,800 members of an online forum for non-offending pedophiles.
He detailed some of his alleged family history in a series of online videos.
'My grandfather sexually abused my mother and I think at least one of his sisters, and my father’s woman was known on the streets to be one that invited the little boys into her house and did things with them,' he said in a video published last month.
'So, I think, she is a pedophile. I know for a fact my father sexually abused several of my sisters – nearly all of them.
'When I was six, my two older sisters taught me to play "go to sleep". My understanding was I was to get them to take their panties off and get them ready to sleep. I don’t think it was abuse, but it left me with the impression that little girls want to be touched.
'When I was about 12, I spent a summer with my cousins and there was some sexual games that went on there… both of these girls were five years younger. I was 12, I think one of them was seven and one of them was five.
'I knew that it was wrong, but frankly in the fifties, every male I knew was sexually attracted to children and little girls.'
In the speech, he then questioned whether pedophilia was something that could be passed down among a family, before saying he never considered himself to be one throughout most of his adult life.
'I had never called myself a pedophile, but for more than 50 years I have been sexually attracted to little girls. I choose not to act on it,' he said.
'I knew I was attracted to little girls, I was always a little close, maybe I hugged them too tight, or did some things I shouldn’t have done, but I never penetrated a child, never – what I would call – had sex with a child.
'I choose not to do that, but I struggle with it.'
His struggles intensified when his first marriage broke down in the nineties, and he decided to 'spend some time out in the South Pacific', where he said there were 'a lot of little girls running around naked'.
After a couple of years he returned home, and met British nurse Tabitha Abel - woman who would become his wife - through a Christian singles dating site in 2004.
They married in 2005. Eventually, they built a log cabin in Oregon, which included rooms for their grandchildren.
But he was still dogged by his desires.
'The first time I remember changing my daughter’s diaper I thought, "Am I going to touch her" or something, but I made the decision right there that was not going to happen,' he said in the video, before explaining how he and his wife chose to adopt foster children because their grandchildren did not visit enough.
Gibson says the children eventually moved on for 'other reasons', however a 10-year-old girl who had lived with him and Abel developed what he called 'false memories'.
'Now you tell me, I mean society says children never lie about sexual abuse. But here the Oregon State Police show up at our door one day and say, "Do you know why I’m here?"' the 65-year-old said.
'They proceeded to tell me this girl disclosed that I lay on the bed naked with her. I said that never happened, and then they said: “Well, she said you put your penis inside of her.” I said that never happened, and they asked me to do a polygraph.
'So I contacted a lawyer, this was like two days before Christmas 2010, the attorney said don’t do the polygraph.'
He said it was that brush with the police that forced him to 'come out' to his wife.
'I told her I didn't do it, but this is where I'm at... I'm attracted to kids,' he said.
During a recent interview, Gibson explained why he is attracted to young girls - but not young boys or teenagers.
The 'comfortably out' pedophile, whose wife is a nurse, said he is normally not aroused by teenage girls and does not have any desire for young boys.
'When they pass 12 they tend to get into themselves, start to make themselves look older, and I like things natural - so there we are,' he told The Sun in the UK.
'When they start wearing lipstick and stuff like that I don't find it very appealing.'
Despite his attractions, Gibson added he is 'a normal everyday person'.
'I don't go around in a white van giving candy to kids in the park,' he said.
Gibson' wife then told the British newspaper she does not consider her husband to be a pedophile because: 'most people I consider a pedophile to be a child molester – which he isn't.'
The interview then went into some more graphic details about Gibson's sexual habits.
He told the newspaper he does not seek out pornography involving children when he masturbates, but added he doesn't 'beat himself up' if he does watch scenes involving young people.
'I don't feel bad it about because it's not reality, I can differentiate between fantasy and reality,' he said.
The 65-year-old also seemed to have come to terms with his life as a pedophile, despite understanding that it makes him unpopular with many.

In the era before TV and movies completely overtook literature as the popular entertainment du jour, however, novels caused their fair share of scandals. In the U.S., books with explicit sexual content were often banned for obscenity, forcing authors to release their novels in France or Italy, where authorities were unconcerned with prosecuting English-language books, instead.
Thanks to the legal challenges from publishers in the 1960s, we no longer have to worry about censors banning books for obscenity (or banning them at all, really). We can happily revisit the novels that set our grandparents’ hair on end (or in a few cases, our great-great-great-great-great-great grandparents) and ushered in out current era of terrible moral degeneracy. Sure, you can read them for their literary and historical value, but if you just want to check out the sexy bits, well, I won’t judge.

Lady Chatterly's Lover
Supposedly this novel contains an anal sex scene, though it went right over my head when I read the book in high school. Regardless, Lady Chatterly's Lover, with its enthusiastic portrayal of extramarital sex, is the most scandalous of Lawrence's many racy novels: although it was first published in 1928, the unexpurgated version of the book was banned in both the U.S. and the U.K. until the 1960s.
And Tango Makes Three
Considerably more adorable than most of the other books on this list, And Tango Makes Three still caused quite the stir when it was published. Social conservatives objected to the book's fictionalized narrative of two male penguins at the Central Park Zoo raising a baby penguin because they worried it sexualized penguins and gave children an inaccurate perspective on reproduction. (How their objections were not immediately overridden by squees I will never understand.)
Fifty Shades Of Grey
As much well-deserved mockery as Fifty Shades of Grey has come in for over the past four years, it's worth remembering that when it first came out, the book opened a new conversation about sexuality — one that may have involved your mom inquiring about fuzzy handcuffs.
This classic YA novel shocked readers in 1975 because it treated the sex lives of teenagers seriously and compassionately. Now, of course, we've moved on to Gossip Girl.
The alternate title of this 1748 novel, Memoirs of a Woman of Pleasure, makes it pretty clear why people objected to the book — especially since it definitely lives up to its name. This book is wall-to wall sex, and, perhaps even more shocking (if not terribly realistic), the titular heroine actually enjoys her dissolute lifestyle and ends up wealthy and married.
Tropic Of Cancer
Like Ulysses and Lady Chatterly's Lover, Tropic of Cancer enraged 20th century moralists and brought down the wrath of censor boards. To be fair, the novel does include quotes like "I will bite your clitoris and spit out two francs," which is, y'know, pretty weird.
This novel's infamous masturbation scene, in which the titular narrator attempts to have sex with a piece of raw liver, ensured that I, at least, will never look at offal the same way again. Although the explicit descriptions of self-pleasure were quite scandalous in 1969, most of the controversy about the novel actually revolved around Roth's irreverent and often unflattering portrayal of Portnoy's Jewish identity and community, which earned him the label of a self-hating Jew.
Though plenty of the books on this list were banned, Justine(along with its companion piece Juliette) is the only one that got its author thrown in an insane asylum. Though De Sade's sexual exploits landed him in plenty of scrapes, it wasn't until Napoleon Bonaparte demanded the author of the scandalous pair of novels be imprisoned that De Sade was put away permanently.
Fear Of Flying
Notorious for introducing the concept of the "zipless fuck," Erica Jong's semi-autoibiographical novel was one of the first to seriously explore women's sexuality and caused a considerable stir when it was published in 1973. Republican Senator Jesse Helms was incensed that public funds had been used to support something "filthy and obscene" (Jong received an NEA grant of $5,000 shortly before publishing the novel), which just goes to show that old dudes yelling at a woman about government funding is a time honored tradition in Washington.
